Please read these Terms and Conditions carefully before using the www.ffat.co.za website (the “Website”) operated by Feather Fur and Target (Pty) Ltd Registration number 2022/551808/07 (“FFAT”) herein after referred to as “us”, “we” or “our”.

Your access to and the use of the Website is conditioned on your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users, and others who access or use the Website.

By accessing or using the Website you agree to be bound by these Terms and Conditions. If you disagree with any part of the terms then you may not access the Website.

FFAT is an online web based shop endeavouring to provide the best quality shooting and hunting products.

Use of Website

You may only use this Website to browse the content, make legitimate purchases, and shall not use this Website for any other purposes, including without limitation, to make any speculative, false or fraudulent purchase. This Website and the content provided in this Website may not be copied, reproduced, republished, uploaded, posted, transmitted, or distributed. Deep-linking, embedding, or using analogous technology is strictly prohibited. Unauthorized use of this Website and/or the materials contained on this Website may violate applicable copyright, trademarks, or other intellectual property laws or other laws.

Disclaimer of Warranty

1. The content of this Website is provided “as is” without warranty of any kind, either expressed or implied, including but not limited to warranties of merchantability, fitness for a purpose and non-infringement. The owner of this Website, the authors of the content, and in general anybody connected to this Website in any way, from now on collectively called “Providers” assume no responsibility for errors or omissions in the content.
2. The Providers further do not warrant, guarantee, or make any representation regarding the safety, reliability, accuracy, correctness, or completeness of the content. The Providers shall not be liable for any direct, indirect, general, special, incidental, or consequential damages (including without limitation, data loss, lost revenues, and lost profit) which may result from the inability to use or the correct or incorrect use, abuse, or misuse of the content, even if the Providers have been informed of the possibilities of such damages. The Providers cannot assume any obligation or responsibility. The use of the content is forbidden in those places where the law does not allow this disclaimer to take full effect.

Return and refund policy

1. Refunds or returns refer to products that are sold on the Website (www.ffat.co.za).
2. Refunds or returns can only be accepted under the following instances:
   1. If the items delivered do not match the description or specifications listed on our Website.
      1. In the event of products delivered that do not match the description or specifications listed on our Website, products can be returned for a refund provided that the following criteria have been met:
         1. It is reported by email within 3 working days from date of delivery to Orders@ffat.co.za.
         2. The item is returned with and in its original packaging and is unused and the packaging is not damaged.
      2. In such an event the item will be exchanged for the correct item or refunded in full at no additional charges.
   2. Items delivered was damaged or broken
      1. The preferred method of return in such instances is to not accept the items when delivered by the delivering party (courier).
      2. The details of the damages and or the reasons for rejecting delivery should be marked on the waybill.
      3. Rejection should immediately be reported by email to Orders@ffat.co.za. If possible, photos should be attached to the email.
      4. In the event of accepting the delivery, the waybill should be marked that packaging was damaged when signing acceptance of the delivery.
      5. Goods should immediately be inspected for damages.
      6. Any damages should be reported within 3 working days to Orders@ffat.co.za
      7. If the above criteria have been met the item/s will be exchanged or refunded.
   3. Cancellation of orders
      1. Orders can only be cancelled for refund or exchange within 7 working days from placement of the order.
      2. Requests for cancellation or refund should be submitted to Orders@ffat.co.za.
      3. Cancellation of orders will be liable for a cancellation fee which is equivalent to any costs incurred for processing of the order i.e. shipping costs, bank charges, etc.
      4. Cancelled orders will only be refunded if goods are returned unopened, unused and undamaged.
3. Refunds or exchanges will only be processed within 3-10 working days from which goods have been received back by FFAT.
4. Refunds/exchanges do not include the shipping charges shown on the packaging slip/invoice. Shipping charges for all exchanges must be prepaid.
5. Any damages or loss to products during shipping will be for the expense of the client.
6. Any amounts refunded will exclude shipping costs. In the event of free shipping provided, the actual shipping costs will be invoiced separately.
7. For all of the above returns or exchanges, we reserve the right to receive and inspect products to validate claims before processing refunds or exchanges.

User Representations

1. By using the Website, you represent and warrant that:
   1. All registration information you submit will be true, correct, accurate, current, and complete;
   2. You will maintain the accuracy of such information and promptly update such registration information as necessary;
   3. You have the legal capacity and you agree to comply with these Terms and Conditions;
   4. You are not under the age of 18;
   5. You are not a minor in the jurisdiction in which you reside, or if a minor, you have received parental permission to use the Website;
   6. You will not access the Website through automated or non-human means, whether through a robot, script, or otherwise;
   7. You will not use the Website for any illegal or unauthorized purpose;
   8. Your use of the Website will not violate any applicable law or regulation.
2. If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any current or future use of the Website (or any portion thereof).

Our Rights

1. We reserve the right to modify or withdraw, temporarily or permanently, the Website (or any part of) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website; and/or
2. We reserve the right to change these Terms and Conditions from time to time and your continued use of the Website (or any part of) following such change shall be deemed to be your acceptance of such changes. It is your responsibility to check regularly to determine whether the Terms and Conditions have been changed. If you do not agree to any change to the Terms and Conditions then you must immediately stop using the Website.
3. We will use our reasonable endeavours to maintain the Website. The Website is subject to change from time to time. You will not be eligible for any compensation because you cannot use any part of the Website or because of a failure, suspension, or withdrawal of all or part of the Website due to circumstances beyond our control.
4. Although all reasonable steps will be taken to ensure that the products and prices as displayed on the Website are correct and stock is available, we reserve the right to only submit the final prices and availability to customers on receipt of a quote request.
5. All orders confirmed by us with a formal invoice, will be valid for 48 hours. Payment must be affected and reflect in the bank account of FFAT within the 48 hours.
6. No goods will be shipped until full payment has been received.
7. All goods will remain the property of FFAT until full payment has been received.

Payment Options and Pricing

1. All transactions will be processed in South African Rands (ZAR).
2. FFAT endeavours to offer you competitive prices on the products within this platform.
3. Payments can be done from your bank app (EFT), or by paying with your debit/credit card.
4. All transactions are secure.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms and Conditions. All provisions of the Terms and Conditions which by their nature should survive termination shall survive termination, including, without limitation, ownership, provisions, warranty disclaimers, indemnity and limitations of liability.

Governing Law

1. These Terms shall be governed and construed under the laws of South Africa, without regard to its conflict of law provisions.
2. Our failure to enforce any right or provision of these Terms and Conditions will not be considered a waiver of those rights. If any provision of these Terms and Conditions is held to be invalid or unenforceable by a court, the remaining provisions of these Terms and Conditions will remain in effect.
3. These Terms and Conditions constitute the entire agreement between us regarding our service, and supersede and replace any prior agreements we might have between us regarding the service.

Guidelines for Reviews

1. You should have first-hand experience with the person/entity being reviewed;
2. Your reviews should not contain offensive profanity, or abusive, racist, offensive, or hate language;
3. Your reviews should not contain discriminatory references based on religion, race, gender, national origin, age, marital status, sexual orientation, or disability;
4. Your reviews should not contain references to an illegal activity;
5. You should not be affiliated with competitors if posting negative reviews;
6. You should not make any conclusions as to the legality of conduct;
7. You may not post any false or misleading statements;
8. You may not organize a campaign encouraging others to post reviews, whether positive or negative;
9. We may accept, reject, or remove reviews in our sole discretion. We have absolutely no obligation to screen reviews or to delete reviews, even if anyone considers reviews objectionable or inaccurate. Reviews are not endorsed by us and do not necessarily represent our opinions or the views of any of our affiliates or partners; and
10. We do not assume liability for any review or any claims, liabilities, or losses resulting from any review. All reviews are only for the company’s account where login details are required.

Monitoring

We have the right, but not the obligation, to monitor any activity and content associated with the Website. We may investigate any reported violation of these Terms and Conditions or complaints and take any action that we deem appropriate (which may include but is not limited to, issuing warnings, suspending, terminating, or attaching conditions to your access and/or removing any materials from the Website).

1. We reserve the right to change, modify, add to or remove from portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions will become effective upon such changes being posted to this Website.
2. The User should periodically check these Terms and Conditions at the Website for changes or updates. The User’s continued use of this Website following the posting of changes or updates will be considered notice of the user’s acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates.

Consent

I understand that all the designs and trademarks are registered to FFAT and hereby accept the Terms and Conditions. I undertake not to copy/duplicate the trademarks and designs directly or indirectly in anyway and understand the legal implications thereof. Should I be found to violate this agreement I understand that I will be held liable for all legal costs incurred by FFAT for any civil action or any legal action deemed necessary against me.
